These Terms of Service ("Terms") are the agreement between you and Boardee Pty Ltd ("Boardee", "we", "us"), a company incorporated in Queensland, Australia, for using our website, the Boardee app at boardee.app, and everything within them (the "Service"). Please read them — by using Boardee, you agree to them.
Agreement to these terms
By creating an account or otherwise using the Service, you accept these Terms and our Privacy Policy. If you're using Boardee on behalf of a school or organization, you confirm you have the authority to accept these Terms for it. If you don't agree, please don't use the Service.
Who can use Boardee
You must be at least 18 years old, or the age of majority where you live, to create a Boardee account. Boardee is built for teachers and other educators to run in a classroom. Students may take part in a board that a teacher is running, but accounts are for adults.
Your account
You're responsible for the information you provide and for keeping your login credentials secure. Everything that happens under your account is your responsibility, so let us know promptly at support@boardee.app if you suspect unauthorized use. Please keep your account details accurate and up to date.
Plans, billing & cancellation
Boardee offers a free plan and one or more paid plans. Key points:
- Free features are provided as-is and may change over time as we improve the Service.
- Paid subscriptions are billed in advance on a recurring basis (for example, monthly or yearly) through our payment provider, and renew automatically until you cancel.
- Cancellation takes effect at the end of your current billing period. You keep access to paid features until then; we don't provide prorated refunds for partial periods except where the law requires it.
- Price changes apply to future billing periods, and we'll give you reasonable notice before they take effect. Taxes may apply on top of listed prices.
Acceptable use
When using Boardee, you agree not to:
- break the law, or infringe anyone's intellectual property or privacy rights;
- upload or create content that is unlawful, hateful, harassing, or harmful to children;
- attempt to access, disrupt, or reverse-engineer the Service or its security;
- use the Service to send spam, malware, or misleading content;
- scrape, resell, or redistribute the Service without our permission; or
- use the Service in a way that overloads or interferes with it for others.
We may suspend or limit access to protect the Service and its users from misuse.
Your content
You keep ownership of the boards and content you create ("Your Content"). You grant us a limited license to host, store, display, and process Your Content only as needed to provide the Service to you — for example, saving your boards and syncing them across your devices. You're responsible for having the rights to any content you upload, and for making sure it doesn't violate the law or anyone else's rights.
AI-generated content
Some features generate widgets, images, games, or text from your prompts. AI output can be inaccurate, unexpected, or similar to content generated for others, so review it before using it with students and don't rely on it as a sole source of fact. As between you and us, you may use the content you generate through the Service, subject to these Terms and the terms of the underlying AI providers. Don't enter sensitive personal information about yourself or your students into AI prompts.
Classroom & student use
You're responsible for how you use Boardee with your students and for complying with the laws and policies that apply to your school or setting — such as COPPA and FERPA in the United States, or the Privacy Act 1988 in Australia — and for obtaining any parental or institutional consent those laws require. Boardee is designed so ordinary classroom use doesn't require students to create accounts; please keep student personal information out of the Service unless you have the right and consent to enter it.
Our intellectual property
The Service — including its software, design, logos, and the tools and games we provide (but not Your Content) — belongs to Boardee and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service under these Terms. Please don't copy, modify, or create derivative works of the Service except as these Terms allow.
Third-party services
Boardee relies on and links to third-party services — such as hosting, payments, and AI providers. Your use of those services may be subject to their own terms, and we're not responsible for third-party content or services we don't control.
Termination
You can stop using Boardee and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. When your account ends, your right to use the Service stops, and we may delete Your Content in line with our Privacy Policy. Sections that by their nature should survive termination — such as content licenses you've granted, disclaimers, and limitations of liability — will continue to apply.
Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or secure, or that any content or AI output will be accurate. Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, Boardee and its team won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred Australian dollars (A$100). Where our liability can't be excluded — including under the Australian Consumer Law — but can be limited, our liability is limited, at our option, to re-supplying the Service or paying the cost of having it re-supplied. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold Boardee harmless from claims, losses, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your breach of these Terms or of any law or third-party right.
Governing law & disputes
These Terms are governed by the laws of Queensland, Australia, without regard to conflict-of-laws rules. Any dispute that isn't resolved informally will be handled by the courts of Queensland, and you submit to their non-exclusive jurisdiction — unless the mandatory law of your home country gives you a different right. We encourage you to contact us first at support@boardee.app so we can try to resolve things directly.
Changes to these terms
We may update these Terms as the Service evolves. When we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you in the app or by email. Continuing to use the Service after a change means you accept the updated Terms.
